Building project to address the outstanding Sanitary Code violations pertaining to the physical construction of the building was not done this summer as previously indicated. Operator indicated that he intends to do it next year. Discussed ill food worker policies with operator and provided CDC "Norovirus: Facts for Food Handlers" fact sheet.

Comments: Discussed the holding temperature of the stand-up refrigerator in the kitchen. Ambient air temperature measured 45 degrees F (max allowable temp). Operator indicated that he recently cleaned the unit in an attempt to improve effeciency, but it did not work. Unit is reportedly scheduled for service. No observable change in the condition of the restaurant since the December 13, 2016 inspection. Cleaning in the establishment is largely satisfactory. Operator indicated that there have been no recent insect of rodent signs. Partial remodeling of the kitchen to correct the remaining violations is still planned for this summer. Recommend re-issuing permit for the remainder of the permit year (ending May 31, 2017).

Comments: Re-inspection of the facility to verify Sanitary Code compliance following the December 13, 2016 Administrative Enforcement Hearing (Docket #16-045). Substantial progress has been made on the cleanliness of the facility, however there are still some outstanding construction issues. Mr. Stavish indicated that he is planning to remodel the kitchen next year and will address the outstanding construction issues at that time. The most recent pest control report (Dec 13, 2016) indicated no insect or rodent activity inside the establishment. Per Dr. Watkins, permit condition #3 restricting food service to pre-packaged food and bottled drinks has been removed. A revised permit was issued without any food service restrictions, set to expire on March 31, 2017. This permit will be renewed/amended based on the results of a reinspection before that date. Food service at the establishement may resume effective immediately.

Comments: Re-inspection requested by Dr. Watkins (Public Health Director) to determine compliance with Board of Health Order (Docket #16-011) as well as permit condition #3 imposed by the BOH following the Aug 31, 2016 re-inspection. Permit condition #3 restricted food service at the establishment to bottled beverages and pre-packaged food only until all outstanding Sanitary Code violations have been resolved. There has been little change in the condition of the establishment since the Aug 31, 2016 re-inspection. All six of the Sanitary Code violations cited in August remain uncorrected. The most recent pest control receipts showed only "minor insect activity" inside the building but no recent evidence of cockroaches or rodents. Substantial evidence of continued food service was found at the establishment during the inspection, despite the BOH order prohibiting it. This evidence included fully stocked coolers/freezers, several boxes of raw chicken wings, dirty dishes/equipment in the kitchen and food waste from the previous weekend found in garbage cans/on the floor. When asked if he was still serving food at the establishment, Mr. Stavish freely admitted to doing so but indicated that it was "mostly on Wednesdays for wing night". After I explained to Mr. Stavish that the BOH placed a condition on his permit preventing him from serving food in the establishment, he indicated that he "misinterpreted" the BOH order and believed he could continue serving food after he had paid his fine. I explained to Mr. Stavish that his interpretation was incorrect and that the prohibition against food service is still in effect. Due reports received by the Health Department that the establishment was not complying with the aforementioned BOH Order and permit condition, an administrative enforcement hearing was scheduled for early December. Comments: Re-inspection required by BOH Order. New tile floor installed since the last inspection. Mr. Stavish indicated that he intends to gut the kitchen and completely remodel it next year in order to correct numerous outstanding construction issues. I explained to Mr. Stavish during the inspection that if he is going to remodel the kitchen, formal plans must be submitted to the Health Department for review and approval prior to construction in order to determine whether or not his plans will be in compliance with Sanitary Code requirements. Cleaning in the establishment has improved, but several non-critical violations remain. Per operator, all dishes are now being washed on premises using the three bay sink. Mr. Stavish indicated that garbages are being emptied at night when he closes at the bar. However, bartenders are still not emptying garbage at night when he is not there due to his safety concerns. Pest control receipts provided upon request during the inspection. Most recent report indicated minor insect activity inside the building, but monitoring traps were OK. Double door cooler unit in the kitchen not maintaining cold holding temperature. Measured temp was 50 degrees F. Only TCS food in the cooler was a bowl containing canned mushrooms, which was discarded during the inspection.
